Off-Leash and Leash-Law Violations

Public parks and most public spaces require dogs to be leashed except in clearly posted off-leash areas or hours. When an owner lets a dog roam or fails to control it and you are bitten or knocked down, we pursue compensation from the dog owner and their homeowners or renters insurance.

FREQUENTLY ASKED QUESTIONS

Who pays for a dog bite?

Usually the dog owner’s homeowners or renters liability insurance. Umbrella insurance can add limits.

New York: Yes. Since the recent decision in Flanders v. Goodfellow (2025), you can sue an owner for negligence even without proof of prior “vicious propensities”; strict liability still applies if the owner knew or should have known.

New Jersey: Yes. NJ’s statute makes owners strictly liable for bites in public or when you’re lawfully on private property, regardless of prior history.

In New York, you can proceed on negligence after Flanders (2025). In, New Jersey, the strict-liability bite statute doesn’t cover non-bite injuries, therefore you typically need to prove negligence.

You may have both workers’ compensation and a third-party claim against the owner/property. NJ’s statute expressly covers people lawfully on property, including those there by legal duty (e.g., postal workers).

In many cases it is three years in New York and two years in New Jersey. Shorter notice rules can apply when public entities are involved, so contact us quickly.
