Your Rights in an Uncontested Divorce
If you and your spouse agree on all major terms, including property division, child custody, support, and debts, your divorce may proceed on an uncontested basis with the court. Residency Requirements
New York
You can file in New York if any one of these is true:
You or your spouse lived in New York continuously for at least 2 years right before filing; or
You or your spouse lived in New York continuously for at least 1 year right before filing and: you married in New York, or you lived together in New York as a married couple, or the reason for the divorce happened in New York.
New Jersey
In most cases, either spouse must have been a New Jersey resident for at least 1 year right before filing.
Exception: if filing on adultery grounds, there is no 1-year minimum. One spouse must be a New Jersey resident when filing.

What is an uncontested divorce?

What if my spouse ignores me?
We serve properly and can ask the court to proceed by default if allowed. If your spouse appears and contests, the case shifts to contested.
How long does an uncontested case take?
A few months is common. Timing depends on the county/venue, court backlogs, method of service, and how quickly everyone signs and returns documents. We’ll give you a venue-specific estimate once we know where the case will be filed.
What happens if the case becomes contested?
We move to hourly billing with an initial retainer and a written budget before major steps. You will always approve next actions.
Do we have to go to court?
Many uncontested cases are fully paper-based. Contested matters may require conferences and hearings.
